Installment Terms & Device Ownership Policy

Plain language document. These terms are written clearly so you understand exactly what you are agreeing to. This agreement is governed by the laws of the Republic of Ghana, including the Hire-Purchase Act, 1974 (NRCD 292) and the Consumer Protection Act, 2012 (Act 851).
These Installment Terms and Device Ownership Policy ("Installment Terms") govern the hire-purchase relationship between Pulseown Mobile ("Pulseown Mobile", "owner", "we", or "us") and a customer ("you" or "hirer") who enters into a hire-purchase plan for a used iPhone device.
By confirming an order and paying your initial deposit, you enter into a hire-purchase agreement with Pulseown Mobile and agree to these Installment Terms.
1. Nature of This Agreement
This is a hire-purchase agreement as defined and regulated by the Hire-Purchase Act, 1974 (NRCD 292) of the Republic of Ghana.
Under this structure: Pulseown Mobile lets the device to you on hire, and you have the right — and upon completing all payments, the obligation — to purchase the device. Legal title and ownership of the device remain with Pulseown Mobile until your final payment has been received and confirmed. At that point, ownership transfers fully and unconditionally to you.
You have the right to use the device for personal purposes throughout the hire period, subject to the obligations in Section 5 of this document.
2. Payment Structure
2.1 Initial Deposit
To confirm your order, you must pay an initial deposit. The deposit amount is 30% of the device price. This amount will be clearly stated in your written plan confirmation before you commit to anything.
The deposit is non-refundable if you cancel the agreement for personal reasons unrelated to any fault on Pulseown Mobile's part, except as described in our Returns & Refunds Policy. If Pulseown Mobile is responsible for a cancellation (for example, because the device was not as described), your deposit will be refunded in full.
2.2 Payment Schedule
After delivery, the remaining balance is paid in scheduled instalments. Your full payment schedule is provided in writing before your order is confirmed, showing:
- Each payment date
- The amount due on each date
- The total hire-purchase price (deposit + all instalments)
- The date on which ownership transfers to you
Plan durations: 3 to 6 months. The specific duration applying to your plan will be stated in your written agreement.
2.3 Accepted Payment Methods
We accept the following payment methods:
- Mobile Money (MTN MoMo, Telecel Cash, AirtelTigo Money)
- Bank transfer to our registered business account
- Cash payment at our business address (receipt will be provided)
All payments must reference your order number. A payment receipt is issued for every payment made.
2.4 Total Cost — No Hidden Fees
The total hire-purchase price equals the sum of your initial deposit plus all scheduled instalments. This total is disclosed to you before you confirm your order. There are no origination fees, service charges, or undisclosed additions. What is written in your plan is what you pay — nothing more.
3. Device Delivery
After your initial deposit is received and confirmed, your device will be prepared for delivery. Before delivery, each device is:
- Factory reset to remove all prior account data
- Updated to the latest compatible iOS version
- Confirmed free of any iCloud activation lock
- Physically inspected and matching its stated condition grade
Delivery timeline and method are confirmed at the time of your order. You will be notified when your device is ready and how it will reach you.
4. Legal Title and Ownership During the Hire Period
This agreement is structured as a hire-purchase under the Hire-Purchase Act, 1974 (NRCD 292). This means:
- Legal title remains with Pulseown Mobile from the date of delivery until the date your final payment is received and confirmed.
- You have full rights to use the device throughout the hire period for personal purposes.
- You must not sell, transfer, pledge, sub-hire, or otherwise dispose of the device to any third party before completing your plan. Doing so is an offence under Section 13 of the Hire-Purchase Act, 1974 (NRCD 292).
- Upon receipt of your final instalment, legal title and full ownership transfer to you automatically, with no further conditions or fees.
5. Your Obligations as Hirer
During the hire period, you agree to:
- Make all scheduled payments on or before the agreed dates.
- Keep the device in reasonable working condition, taking care not to cause intentional damage or neglect that would substantially reduce its value.
- Not sell, gift, sub-hire, pledge, or transfer the device to any other person before completing the plan.
- Notify Pulseown Mobile promptly if your phone number, email address, or physical address changes.
- Allow reasonable access if Pulseown Mobile needs to inspect the device in connection with a genuine concern under this agreement.
- Co-operate with our support team if a dispute or question arises about the plan.
6. Device Condition at Delivery
Devices are delivered in the condition grade stated in your written order confirmation (Grade A, B, or C). If you believe the device you received materially differs from the agreed description, you must notify us within 48 hours of receipt at support@pulseownmobile.com.
We will investigate and, where the device genuinely differs from its stated condition, we will offer an appropriate remedy in line with our Returns & Refunds Policy and the Consumer Protection Act, 2012 (Act 851).
7. Late and Missed Payments
We understand that financial circumstances can change. If you anticipate difficulty making a scheduled payment, please contact us before the due date at support@pulseownmobile.com. We will discuss your situation in good faith.
7.1 Written Notice Requirement (NRCD 292, Section 5)
In accordance with the Hire-Purchase Act, 1974 (NRCD 292), Pulseown Mobile is not entitled to enforce any right arising from a missed payment — including the right to accelerate the remaining balance, terminate the agreement, or repossess the device — unless and until we have:
- Served you a written demand specifying the payment obligation that has not been met and requesting that you remedy it within a stated period; and
- That period is not less than fourteen (14) days from the date the written demand is served; and
- You have failed to comply with the demand within that fourteen-day period.
Written notice will be sent to your registered email address and, where available, your WhatsApp or phone number.
7.2 Protected Goods — Your Enhanced Rights After 50% Payment
The Hire-Purchase Act, 1974 (NRCD 292), Sections 8–11, provide important additional protections once you have paid one half (50%) or more of the total hire-purchase price. At that point, the device becomes "protected goods" under Ghanaian law, and the following apply:
- Pulseown Mobile cannot repossess the device without a court order. We may apply to a Ghanaian court for such an order, but we cannot take the device from you without one.
- If Pulseown Mobile wrongfully recovers possession of protected goods without a court order or your written consent, the hire-purchase agreement is immediately terminated by operation of law, and you are fully released from all remaining payment obligations under NRCD 292.
- A court, upon application, may exercise discretion to allow you to retain the whole device on condition that you pay the outstanding balance, or may make such other order as it considers just.
These rights are provided to you by statute and cannot be contractually waived or reduced.
7.3 Late Payment Fee
A late payment fee may apply to overdue instalments. If applicable, the amount will be stated in your written payment plan before you confirm your order. No undisclosed late fee will be charged.
8. Ownership Transfer
Full legal ownership of the device transfers to you upon receipt and confirmation of your final scheduled instalment. This transfer is unconditional — no further fees, conditions, or steps are required beyond completing your agreed payment plan.
Pulseown Mobile will issue written confirmation of ownership transfer upon receipt of your final payment. You are entitled to request this confirmation at any time.
9. Early Repayment
You have the right to settle the outstanding balance of your hire-purchase agreement early at any time. To do so:
- Contact us at support@pulseownmobile.com to request your current outstanding balance.
- We will confirm the exact settlement figure in writing within two business days.
- Pay the confirmed amount using an accepted payment method.
- Upon receipt of full payment, ownership transfers to you immediately and we will issue written confirmation.
No early repayment penalty applies. You will never pay more than the total hire-purchase price stated in your original agreement.
10. Your Right to Terminate (Hirer's Right)
Under Section 6 of the Hire-Purchase Act, 1974 (NRCD 292), you have a statutory right to terminate this hire-purchase agreement at any time before the final payment falls due by:
- Giving written notice to Pulseown Mobile at support@pulseownmobile.com.
- Returning the device to us in a reasonable condition.
Upon valid termination under this section, your liability is limited to:
- Any instalments already due and unpaid at the date of termination; and
- Any amount required to bring your total payments up to one half (50%) of the total hire-purchase price, if you have paid less than that amount at the time of termination — unless the court considers it just to order a lesser amount.
- Compensation for any damage to the device beyond reasonable wear and tear.
Payments made above the 50% threshold are not recoverable under this termination clause. This statutory termination right does not apply if the agreement was terminated due to your breach (see Section 7).
11. Pulseown Mobile's Right to Terminate
Pulseown Mobile may terminate this agreement if you:
- Fail to remedy a missed payment after receiving the 14-day written demand described in Section 7.1; or
- Sell, transfer, pledge, or otherwise dispose of the device during the hire period in breach of Section 5; or
- Deliberately damage or destroy the device.
Upon termination for breach, Pulseown Mobile may seek recovery of the device and any unpaid amounts through the appropriate Ghanaian court, subject to the protections described in Section 7.2 where applicable.
Any termination action will comply fully with the Hire-Purchase Act, 1974 (NRCD 292), and the Consumer Protection Act, 2012 (Act 851). We commit to not using self-help remedies outside the scope of Ghanaian law.
12. Warranty
30-day limited functionality warranty covering hardware defects present in the device at the time of delivery. Cosmetic wear consistent with the stated condition grade is not covered.
If you experience a warranty issue, contact us at support@pulseownmobile.com within the warranty period with a description of the fault. We will assess the issue and provide a remedy (repair, replacement, or refund) consistent with the Consumer Protection Act, 2012 (Act 851).
This warranty does not affect your statutory rights as a consumer under Ghanaian law.
13. Returns
Returns are governed by our Returns & Refunds Policy. Please review that document for full details on eligibility, process, and how refunds are handled.
14. Dispute Resolution
If a dispute arises in connection with your hire-purchase plan, the following process applies:
14.1 Direct Resolution (First Step)
Contact our support team directly at support@pulseownmobile.com. We will acknowledge your complaint within two business days and work in good faith to reach a fair resolution. Most disputes can be resolved at this stage.
14.2 Mediation
If direct resolution fails, either party may refer the dispute to mediation under the Alternative Dispute Resolution Act, 2010 (Act 798)of Ghana. Mediation will be conducted by a mutually agreed mediator or an institution recognised under Act 798. The costs of mediation will be shared equally between the parties unless otherwise agreed. Any mediated settlement reached is binding on both parties.
14.3 Arbitration
If mediation is unsuccessful or not agreed to, disputes shall be referred to and finally resolved by arbitration in Ghana in accordance with the Alternative Dispute Resolution Act, 2010 (Act 798). The seat of arbitration shall be Accra, Ghana. The language of the arbitration shall be English. The arbitral award shall be final and binding.
14.4 Courts
Nothing in this Section prevents either party from seeking urgent interim relief from a Ghanaian court, or from referring a matter to the appropriate court if arbitration is not applicable to the nature of the claim. The courts of Ghana have jurisdiction over any matter not resolved by mediation or arbitration under this clause.
You also have the right to lodge a complaint with the Ghana Consumer Protection Agency established under the Consumer Protection Act, 2012 (Act 851), if you believe your consumer rights have been violated.
15. Governing Law
These Installment Terms are governed by and construed in accordance with the laws of the Republic of Ghana. The principal statutes governing this agreement include:
- Hire-Purchase Act, 1974 (NRCD 292)
- Consumer Protection Act, 2012 (Act 851)
- Sale of Goods Act, 1962 (Act 137)
- Alternative Dispute Resolution Act, 2010 (Act 798)
- Contracts Act, 1960 (Act 25)
Any provision of these terms that conflicts with mandatory Ghanaian law is severable and shall not affect the validity of the remaining provisions.
