These Terms of Service ("Terms") govern your use of the website at https://pulseownmobile.com and any services offered by Pulseown Mobile ("Pulseown Mobile", "we", "us", or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or services.

1. About Pulseown Mobile

Pulseown Mobile is an independent seller of quality-checked iPhones operating under a hire-purchase model in the Republic of Ghana. We are not affiliated with, authorised by, endorsed by, or in any way officially connected with Apple Inc. "iPhone" and "Apple" are trademarks of Apple Inc. used here for descriptive and identification purposes only.

Our hire-purchase agreements are governed by the Hire-Purchase Act, 1974 (NRCD 292) and the Consumer Protection Act, 2012 (Act 851) of Ghana.

2. Website Use

You may use this website only for lawful purposes. You agree not to:

  • Infringe the intellectual property or other rights of any third party.
  • Transmit any content that is harmful, fraudulent, defamatory, obscene, or otherwise unlawful under Ghanaian law.
  • Attempt to gain unauthorised access to any system, account, or data associated with this website.
  • Interfere with, disrupt, or damage the normal operation of this website or its underlying infrastructure.
  • Use the website in any manner that violates the Electronic Transactions Act, 2008 (Act 772) or any other applicable Ghanaian law.

3. Accuracy of Information

We make reasonable efforts to ensure all information on this website — including device descriptions, condition grades, and plan terms — is accurate and current. However, we do not warrant that content is entirely free from error. Device availability and pricing are subject to change.

Your confirmed order and hire-purchase agreement, provided to you in writing at the time of your plan, governs your transaction. The website is informational; the written plan document is contractual.

4. Hire-Purchase Agreements

Your use of our installment plan service is governed by our Installment Terms & Device Ownership Policy, which constitutes your hire-purchase agreement with Pulseown Mobile under the Hire-Purchase Act, 1974 (NRCD 292). These general Terms of Service govern website use; the Installment Terms govern your specific hire-purchase transaction.

5. Intellectual Property

All content on this website — including text, graphics, logo, design, and layout — is the property of Pulseown Mobile or used under licence. You may not reproduce, distribute, publicly display, or create derivative works from any content without our prior written permission.

"iPhone", "Apple", and related marks are trademarks of Apple Inc. Their use on this site is solely for product identification and descriptive purposes. No relationship with, or endorsement by, Apple Inc. is implied or claimed.

6. Disclaimers

The information and content on this website are provided on an "as is" and "as available" basis. To the extent permitted by Ghanaian law, Pulseown Mobile excludes all implied warranties relating to the website itself — including implied warranties of merchantability or fitness for a particular purpose — with respect to the operation of the website as an informational platform.

This exclusion does not affect your statutory rights as a consumer of goods under the Consumer Protection Act, 2012 (Act 851) or the Sale of Goods Act, 1962 (Act 137). Warranties relating to devices sold are addressed separately in our Installment Terms and Returns & Refunds Policy.

7. Limitation of Liability

To the fullest extent permitted by the laws of the Republic of Ghana, Pulseown Mobile shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from:

  • Your use of, or inability to access, this website (including technical interruptions or errors on the website).
  • Reliance on information contained on the website before a written order confirmation has been issued.

This limitation does not apply to:

  • Death or personal injury caused by our negligence.
  • Fraudulent misrepresentation.
  • Any liability that cannot be excluded or limited under the Consumer Protection Act, 2012 (Act 851) or any other mandatory provision of Ghanaian law.
  • Any defect in a device sold to you — which is governed by the Installment Terms, the Sale of Goods Act, 1962 (Act 137), and the Consumer Protection Act, 2012 (Act 851).

Where liability cannot be excluded, our total liability to you for any claim arising from the use of our website (not from the hire-purchase agreement itself) is limited to the amount you paid, if any, for accessing the specific service that gave rise to the claim.

8. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Ghana. The courts of Ghana have exclusive jurisdiction over any dispute arising from or connected to these Terms.

For disputes relating to your hire-purchase plan, the dispute resolution process in our Installment Terms (Section 14) applies, including mediation and arbitration under the Alternative Dispute Resolution Act, 2010 (Act 798).

9. Electronic Communications

Your use of this website and any communication with us by email or electronic message is subject to the Electronic Transactions Act, 2008 (Act 772) of Ghana. Electronic communications sent to and from Pulseown Mobile are valid and may constitute binding communications where appropriate.

10. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under Ghanaian law, that provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

11. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be published on this page with a revised "Last updated" date. Your continued use of the website after changes are posted constitutes your acceptance of the updated Terms.
